Fees and Terms of PPI reclaim service of UK Finance Online Limited
Outline of our Terms of Business
The following constitutes the Terms of Business of UK Finance Online Ltd trading as Money Health Check in acting on the Clients behalf in all aspects of the administration and negotiation of the claim. UK Finance Online Ltd is regulated by the Ministry of Justice in respect of regulated claims management activities. Our authorisation number is CRM10564.
- 1. Definitions: For the purposes of these Terms of Business
- 1.1.
- References to “we”, “us” and “our” are UK Finance Online Limited trading as Money Health Check (henceforth referred to as MHC), or its appointed legal representatives.
- 1.2.
- References to “you” and “your” are to the Client whose details are set out in the Letter of Authority and who have appointed MHC to act on an exclusive basis with regard to the Claim.
- 1.3.
- The ”Claim” means a pursuant action for compensation, redress or refund, including all interest, with respect to a mis-sold Personal Protection Insurance policy, also known as Personal Loan Protection (PLP), Accident, Sickness and Unemployment cover (ASU) or Life and Accident, Sickness and Unemployment (Life and ASU).
- 1.4.
- “Compensation payment” means any sum of money paid as compensation, redress payment or refund amount agreed to be paid by the product provider, bank, building society or selling agent.
- 1.5.
- “Letter of Authority” means the letter to be signed and returned by yourself in order to authorise our legal representative to act on your behalf in all dealings in respect of your claim against a product provider and confirming acceptance of these Terms of Business.
- 1.6.
- “Product provider” means an insurance company, bank, building society, independent financial adviser or other financial institution.
- 2. Services
- 2.1.
- MHC shall act in your best interests in pursuing any claim for compensation from the mis-selling of Personal
Protection Insurance (PPI).
- 2.2.
- MHC will assess your claim and instruct its own legal representatives to pursue your claim at no additional cost to you.
- 2.3.
- Any further legal action not relating to the specified PPI claim will be deemed outside the scope of these Terms of Business. Our legal representatives will be available to direct you should further action be necessary.
- 3. Fees payable if we are successful with your claim
- 3.1.
- You agree to pay us a fee equal to 33% of any compensation amount recovered if we are successful with your claim.
- 3.2.
- You agree that we may receive the compensation payment from the product provider on your behalf. Any payments received on your behalf will be held in your name in a Client Account until such time as it is appropriate to disburse the funds.
- 3.3.
- You agree that upon receipt of any payments of compensation the fees due to MHC will become immediately payable. You agree to notify MHC immediately upon receipt of compensation, whether in part or full, made to you directly by the product provider in connection with the claim. Upon receipt of notification of a payment made to you directly, you will be issued with an invoice, based on the amount paid, and agree to pay the invoice immediately.
- 4. Administration Fees
- 4.1.
- MHC deduct £149.00 in respect of administration from the first successful claim. There are no administration fees for further claims.
- 5. What happens if your claim is unsuccessful?
- 5.1.
- If we are not successful in achieving an offer to pay compensation following your claim you do not have to pay a fee to us.
- 5.2.
- MHC makes no guarantee as to the success, whether wholly or partially, of your claim.
- 6. Communications
- 6.1.
- We will act in absolute good faith and similarly rely on the information and documents you provide us with as being true, correct and complete. - 6.2.
- Unless otherwise instructed, we shall communicate with you at your home address, normally by letter sent by normal postal services or, where appropriate, courier services. We shall send you letters by fax to an agreed fax number only where specifically instructed.
- 6.3.
- We will make reasonable endeavours to ensure that any e-mails that we send to you are free from viruses and any other material that may cause inconvenience or harm to any other computer system, and you undertake to do likewise with any e-mails that you send to us.
- 7. Complaints
- 7.1.
- If at any time you wish to make a complaint about any aspect of the advice or service you have received from MHC the matter will be dealt with through our internal complaints handling procedure, a copy of which is available, upon request. - 8. Data Protection Act 1998
- 8.1.
- During the period of our engagement we shall request information about your personal and financial situation from you. All data is held in accordance with the Data Protection Act 1998.
- 8.2.
- We shall not, without your prior written consent, disclose any confidential information concerning your personal or financial situation to third parties except to other professional advisers whom we may consult in relation to our work, unless otherwise required by law.
- 8.3.
- The working papers prepared as part of our service are our property and shall be retained by us in accordance with our policies and procedures.
- 9. Liabilities
- 9.1.
- MHC will not be liable for such losses incurred due to the provision of false, misleading or incomplete information or documentation or due to any acts or omissions of any person other than MHC.
- 9.2.
- MHC shall have no other liability of any nature, whether in contract, tort or otherwise, for any losses whatsoever and howsoever caused arising from or in any way connected with the provision of its service to you.
- 9.3.
- Nothing in these Terms of Business shall exclude or restrict any liability arising from fraud or dishonesty or other liabilities which cannot lawfully be limited or excluded.
- 9.4.
- You have the right to cancel your instructions to us, without any cost to you, within seven working days of our receiving these written instructions. You can cancel the agreement by delivering a note cancelling your instructions to our office by post, fax or e-mail.
- 9.5.
- By signing and returning the Letter of Authority you are agreeing that our legal representative should be allowed to provide their services for such a period as to allow for completion of the claim, and that no time period has been guaranteed.
- 10. Third Party Rights
- 10.1.
- A person who is not a party to this agreement has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms of this agreement.
- 11. Commencement, variation and termination
- 11.1.
- We will commence work on your claim only upon receipt of your signed Letter of Authority and these Terms of Business.
- 11.2.
- These Terms of Business may be varied or superseded at any time, in writing, by us.
- 11.3.

- 12. Invalidity
- 12.1.
- If any provision (whether in whole or in part) of these Terms of Business is held to be illegal, invalid or unenforceable under any enactment or rule of law, such provision or part shall be deemed not to form part of these Terms of Business, and the legality and enforcement of the remainder of these Terms of Business shall not be affected.
- 13. Governing Law
- 13.1.
- These Terms of Business set out the entire agreement between you and MHC. Neither party may rely on any agreement, understanding or arrangement, which is not expressly set out in the Terms of Business.
- 13.2.
- These Terms of Business shall be governed by, and construed in accordance with English Law.
