We receive a lot of calls and emails from the public asking; "Will interest and other charges be frozen while the IVA is being set up?".
Whilst the IVA is being set up the creditors can continue to charge interest and other charges. However once the IVA is set up live then all charges and interest stop.
The whole reason that people opt for an IVA is so that they can come to a formal and legally binding arrangement with their creditors rather than having to go bankrupt.
An IVA is a formal arrangement between your unsecured IVA creditors and yourself. You agree to pay what you can reasonably afford towards the debts you owe. This agreement is usually for 60 months. In return your creditors agree to write-off the amount still outstanding at the end of the IVA. Interest and other charges are frozen.
An IVA is a legally binding formal arrangement between the borrower of unsecured loans (credit cards, personal loan and store cards) and their lenders (creditors).
With an IVA, a reduced monthly repayment proposal is made on behalf of the borrower to the lenders by a Licensed Insolvency Practitioner (for example, a repayment of 40 pence in the pound).
A full proposal (including the background circumstances leading up to the debt) is put in front of the lenders. If the lenders believe that this is their best way of securing (at least) a percentage of the money owed to them, they will vote to accept the proposal. Once the creditors agree to an IVA, interest and charges are usually frozen and the debtor is protected from debt recovery action.
Whilst being in an IVA can sometimes be a limiting procedure for the debtor (they are unable to obtain further credit facilities), it avoids the embarrassment and inconvenience of bankruptcy and protects the debtor's home and assets from the creditors.
