We receive a lot of calls and emails from the public asking; "Will an IVA affect the people I live with?"
Data protection law now states that one person’s financial circumstances should not affect the other people at the same address.
There is nothing to worry about in this instance as your parent’s credit rating or any other person who shares your address will not be affected by an IVA taken out by someone else in the house.
An IVA will be registered at the place where you live on your credit file and in the Individual Insolvency Register at the address you live.
The only time that an IVA could affect the people you live with is if there is a financial link such as joint bank account, joint loan or credit card linking the two of you up.
In theory because your IVA is in your name it will not affect the people you live with. The whole credit reporting system has been modified so that other people who you live with credit or personal information is not mixed up with the person’s credit being searched.
An IVA proposal is taken out by some people you want to keep their financial matters private. This is why they would choose an IVA because it is not advertised in the newspapers like bankruptcy is. An IVA will not affect any financial or personal affair of anyone in the household unless the IVA includes joint debts.
If you talking out an IVA and wish to request a disassociation from others sharing the same name and address as you, you'll need to send a letter to the Credit Reference Agencies requesting this. The credit reference agency will can you create a disassociation between other people you live with, in order that financial data relating to her does not appear on my credit file from then.
Dear Sirs
[YOUR FULL NAME]
[YOUR DATE OF BIRTH]
[YOUR FULL ADDRESS]With reference to my credit file I am writing to advise you I no longer have any financial connection with [NAME AND DATE OF BIRTH OF PERSON YOU WANT TO BE FINANCIALLY DISASSOCIATED FROM].
Please disassociate us, so that financial information about him/her no longer appears on my file, and the information about me does not appear on his/hers.
Yours faithfully
Please note
An Individual voluntary arrangement (IVA) may stay on your credit reference file for 6 years from the date of the arrangement(even if your IVA has been completed). If your IVA lasts longer than 6 years, it will remain on your credit reference file for the length of the arrangement. If your IVA has been completed, you may need to send proof to the credit reference agencies.
