We receive a lot of calls and emails from the public asking; "What if my circumstances change whilst in an IVA?".
Most IVA cases last for 5 years. Over this people it is not uncommon for the person’s personal circumstances to change. If you have a problem or just need to change the IVA slightly it is always best to be honest and ask the IVA Insolvency Practitioner by letter.
Please find below some typical reasons why an IVA needs to be changed to reflect a change in circumstance:
If the personal circumstance affects the IVA payment the IVA Insolvency Practitioner will have to contact the IVA creditors and hold a special IVA meeting to vary the terms of the IVA.
Yes an IVA can be settled early and unlike a mortgage or loan there will not be an early redemption penalty. In fact if an IVA is paid off early the creditors may allow a discount because they will get their money quicker than expected.
No. When the creditors vote on the IVA proposal, they are voting for at least a minimum amount of their money back over the 5 years, but, they retain the right to have 100% of the debt repaid should your circumstances improve.
There will be a Windfall clause in the terms of the IVA, which states that any additional monies that you come into during the term of the IVA, such as inheritances and lottery wins etc are to be shared for the benefit of the creditors, thereby offering them a better dividend, and getting closer to the 100% that they are always entitled to receive back. If you fail to disclose such additional benefits, the IVA proposal could fail.
