We receive a lot of calls and emails from the public asking; "Can I cancel the IVA once it is set up?".
Ideally you should not cancel an IVA once it is set up. However if your circumstances change and your budget becomes unrealistic then the sensible action to take would be to cancel the IVA.
An IVA is a detailed legal contract and ideally you should not cancel it. However if have had a change in circumstance or cannot live with the IVA then you may stop making payments and then inform the IVA insolvency practitioners that you can no longer continue.
If you cancel the IVA then you will receive a certificate of default and failure. Your creditors will be informed of the IVA failing.
Money Advice Direct speak to a lot of people who have been wanted to cancel their IVA because they feel the IVA had put them in a worse situation than before they went in.
A lot of people cancel their IVA because of excessive charges, unrealistic levels of set repayments and being pressured into IVAs.
In most cases IVA failure is due to the debtor stopping monthly repayments because some IVA insolvency practitioners sometimes pressure clients into unrealistic IVA agreements.
In some cases we have seen people being put on IVA plans that are simply too strained and they can't make the repayments. A creditor may say that they will only accept a certain amount and the insolvency practitioner will push the debtor to meet that target.
An IVA can fail for a variety of reasons. It could be that funds are not being paid into the IVA arrangement or that a change in circumstances means you no longer have any available surplus income.
It is important to remember that the IVA Supervisor is there to help you with any problems during the term of the IVA and if you feel that things are likely to change, you should contact them as soon as possible.
A Notice of Breach will be issued if the IVA falls into arrears. This allows 30 days for the problem to be rectified.
