We receive a lot of calls and emails from the public asking; "I've received a 'Notice of Breach' from my IVA supervisor - what does this mean?".
When the IVA was approved and accepted by you, you agreed to abide by the terms and conditions. If you fail to do so, then you are in breach of the IVA and the IVA Supervisor will issue a Notice of Breach.
This Notice will explain the breach and advise you that you have to remedy the breach within one month of the notice being sent. You will be required to explain the reason for the breach and how you plan to resolve it.
The Supervisor may expect that you need to compensate the Creditors for a reduction in the dividend caused by the breach. This will need to be discussed with the Supervisor.
If the breach cannot be remedied, the IVA could be failed and the Supervisor could commence Bankruptcy proceedings. The first stage would be to issue a Certificate of Termination.
