We receive a lot of calls and emails from the public asking; "What happens if I’ve missed IVA payments or received a notice of breach and there is no solution?".
If you have missed IVA payments and you cannot afford to make the payments up, the Supervisor can ask the creditors for a variation meeting. A new financial statement will be drawn up and a revised proposal can be offered to the creditors. It will, however, be the creditor’s decision whether they will accept the new offer.
The Notice of Breach is notification that if the IVA terms are not adhered to and the missing repayments caught up, the IVA could fail.
If the offer is not accepted or a solution cannot be found, then the IVA will be failed.
A Certificate of Termination will be issued and a copy will be sent to you and to the Creditors.
s part of the IVA, the Supervisor will have retained sufficient funds to be able to present a Bankruptcy Petition.
