We receive a lot of calls and emails from the public asking; "What happens when the IVA variation process has been rejected by creditors?".
If the creditors fail to accept the new proposals the terms and conditions laid down in the original IVA are still binding.
As long as you have not defaulted on the original IVA, then it is essential that you continue to pay the monthly IVA payments until the IVA is completed.
This is the likely scenario if your variation was requested on the basis of a full and final offer being made, but rejected.
If the variation was requested because you had defaulted on the original IVA and the offer of revised payments wasn’t accepted, leaving you unable to maintain the current level, then the most likely outcome would be that the IVA could fail. You should contact the IVA Supervisor to discuss what is going to happen.
