Once the Debt Relief Order application has been submitted online it is The Official Receiver at The Insolvency Service’s decision on whether to approve the Debt Relief Order.
He will check the application to ensure that the information is accurate. He will use various methods to check what has been submitted including looking at the applicants Credit File.
The applicant will be notified of the decision as will the Intermediary.
The applicant’s debts are then subject to the Debt Relief Order. A Moratorium period then starts, which normally lasts for 12 months. During the 12 months no payments are necessary to the qualifying debts. All enforcement action is suspended by the creditors, providing the Debt Relief Order remains in force.
It should be noted that the Official Receiver has the right to review any Debt Relief Order and action can be taken if he/she finds any irregularities.
The Official Receiver has the right, once a Debt Relief Order is in force, to ask the client to provide information on anything relating to the Debt Relief Order as and when necessary.
If the Debt Relief Order is not approved, the Intermediary will be able to find out why. If the Debt Relief Order is declined the client is still liable to pay the debts and remains subject to whatever action the creditors take.
